Comparing FR/BAR and NABOR Contracts: What You Need to Know

Two of the most commonly used agreements are the FR/BAR (Florida Realtors/Florida Bar) Residential Contract for Sale and Purchase and the NABOR (Naples Area Board of REALTORS®) Sales Contract. Key Differences Between FR/BAR & NABOR Contracts

- BAR is widely used across Florida and follows standardized state regulations.
- NABOR is more tailored to Collier County and can cause confusion when used elsewhere.
✅ Inspection & Repairs
- FR/BAR breaks inspections into categories (General, Wood Destroying Organisms, and Permits). Sellers are only required to make repairs within agreed limits.
- NABOR gives buyers more flexibility by allowing them to request repairs, credits at closing, or both, with a clear dispute resolution process.
✅ Closing & Extensions
- FR/BAR allows for automatic extensions under certain conditions, such as loan approval delays.
- NABOR provides for a 10-day extension if lender delays occur after the financing contingency is waived.
✅ Deposit & Default Terms
- FR/BAR defines all deposits collectively, which impacts how liquidated damages are calculated in case of default.
- NABOR does not collectively define deposits, and its default provisions allow for more buyer flexibility.
